Website Bodyguard Maintenance Agreement
Introduction
This Maintenance Agreement (“Agreement”) is entered and effective as of today's date (“Effective Date”) by and between you , your employees, team members (collectively “Client” or “You”) and WP Rockstar ( collectively “Company”, “We”, “Our”). It applies to the purchase of all Monthly Website Maintenance Services (hereinafter collectively referred to as “Maintenance Services” ) ordered by Client.
Maintenance Services
WP Rockstar agrees to provide you, the client, with Maintenance Services as described in this Agreement. Maintenance Services include:

-Daily checks for updates*
-WordPress Core Updates
-Theme/Plugin Updates
-Daily Backups (files+database)
-Unlimited Site Restores from backup
-RealTime Uptime Monitoring
-RealTime Security Monitoring
-Weekly Security Audits
-Site Cleanup in case of Hack
-SSL Certificates Included (Let’s Encrypt)
-Broken Link Fixes
-Redirection Management
-SPAM cleanup
-Access to my Premium Plugins Library
-VIP Discount 20% off on any future work
-Email Support for questions
-Unlimited Website Tasks**
-Unlimited Graphic Design***
-Priority Support***
*Sometimes updates might be delayed due to a conflict or for other reasons.
Services beyond the ones specified above are not included and would be considered project based, with it's own unique contract.

Client Responsibilities
You understand that website security is a combined effort and agree to do your part in keeping your website(s) secure by following the outlined guidelines:
All users that access the website need to have an antivirus installed on their device (even Apple products).
When accessing the website from co-working spaces, cafe’s and other unsecured networks (wi-fi with public password or no password), you need to use a VPN (Virtual Private Network).
User credentials should be stored securely and only shared via secure form or password manager.
When creating new user credentials: Usernames must be at least 10 characters long of random letters and numbers. Passwords must be at least 20 characters long of random letters, numbers and special characters.
Premium plugins and theme that are not part of the plugin library we offer must be purchased and kept up to date at all times to receive updates and support for them.
These guidelines are also outlined in more detail in your Website Bodyguard Welcome Packet which you can access at any time.
If you don’t follow these guidelines and your site gets hacked, the responsibility will fall on you in case there are any extra clean up or other fees involved.
As long as you do everything you can to keep your devices secure and follow proper security measures then we will do our part to protect you and do any needed cleanup in the event of a hack.
Client Email Newsletter
We like to keep client communication open and transparent so we will share any business or industry news that may directly or indirectly impact you.
You agree to receive email communication from us as long we are in a client/service provider relationship.
You can also opt out of these emails at any time by clicking the unsubscribe button in one of the emails or by notifying us via email.
Domains
Client is fully responsible for payment and renewal of their domain. In the event where a domain is not renewed and the domain is lost, WP Rockstar will not be held responsible.
Hosting
Hosting is provided by WP Engine and agreeing to this contract you also accept and agree with their policies and terms of use listed at https://wpengine.com/legal/
When issues arise at the hosting level we will do everything possible to minimize any impact but at times there is nothing we can do and have to wait resolution from the host.
WE WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY A DISTRIBUTED DENIAL-OF-SERVICE ATTACK, VIRUSES OR OTHER TECHNOLOGICALLY HARMFUL MATERIAL THAT MAY INFECT SERVER EQUIPMENT, COMPUTER PROGRAMS, DATA OR OTHER PROPRIETARY MATERIAL.
WE WILL NOT BE LIABLE FOR ANY EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA AND ANY OTHER LOSSES.
Backups
We care about the security of your website and want to make sure it is secure in the event of a unforseen crash so we backup your website (files+database) daily. We keep 3 different backups, in case one is unavailable there is a backup for a backup. These backups are stored in a encrypted form on the server of WP Engine (kept for 60 days), storage of ManageWP (kept for 90 days) and Google Drive (kept for 30 days).
Fees & Payments
Website Bodyguard Maintenance Services are automatically deducted from your preferred payment method that you entered at time of sign up. If at any time you need to change your preferred payment method you can email us directly at
[email protected] to notify us.
We are not responsible for any overdraft fees you incur if your card is declined or overdrafted. If you need to postpone your payment for any reason please contact us at least 1 business day prior to your payment due date so that we can postpone the payment in our system.
If your payment is declined we will try again 2 more times. If the payment is declined on the 3rd try and we don't hear from you within the next 7 days your services will be cancelled, you website backup will be sent to you and all your data in our system will be deleted.
Third Party Providers
WP Rockstar, just like any other business, needs to use tools and services to help carry out business processes. The following third parties may have access to your Personally Identifiable Information:
WP Engine (Austin, TX, USA) - hosting
WordPress/Automattic (San Francisco, CA USA) - content management system
ManageWP (Scottsdale, AZ, USA) - website management system
LastPass (Fairfax, VA, USA) - password manager
17Hats (Pasadena, CA, USA) - client/project management system
Asana (San Francisco, CA USA) - project management system
Stripe - billing
HelpScout (Boston, MA, USA) - ticketing system
Cloudflare (San Francisco, CA USA) - DNS, performance and security
ConvertKit (Portland, OR, USA) - email marketing provider
Active Campaign (Chicago, IL, USA) - email marketing provider
All the third party providers are located in the US which is where WP Rockstar is located as well. By signing this contract you agree and understand that your data is held in the US.
Contractors & Team Members
WP Rockstar reserves the right to hire contractors to carry out work on our behalf. In the event that we do subcontract some data will be shared with the contractors that is needed to complete their work. This also applies to any team members we bring on. We are very selective in who we work with and uphold contractors & team members to our privacy and security policies.
Client Security & Privacy
We take your security and privacy very seriously and no information is shared with anyone other than the third party providers, subcontractors/team members, you or your authorized team members (if applicable). We will never sell your data.
You also have the right to be forgotten which means any data we have on you will be deleted per your request. However some data is needed to be able to provide you with our services. In the event that you terminate our client/service provider relationship your data will be fully removed within the next 5 business days after your cancellation.
Data Breach Disclosures
We will do everything possible to prevent data breaches on our end but some things are out of our hands like third party provider data breaches. While we carefully choose who we do business with to protect you and ourselves, security issues can still happen to even the best protected systems, there is never 100% guarantee.
In the event of a data breach or any other security related issues we agree to disclose within 72 hours of us knowing that a data breach has occured . We are always transparent and will provide you with anything we find and more as new information comes to life.
Termination & Refunds
We provide a 30 day money back guarantee which you can exercise by email requesting a refund within 30 days. No refunds will be issued past 30 days.
Sometimes needs change and, in the event when you no longer need our services, you can terminate our client/service provider relationship by notifying us about it via email at any time. To avoid any further charges please make sure to notify us at least 1 business day before your scheduled payment due date.
Severability
No part of this Agreement will be affected if any other part of it is held unenforceable or invalid.
